Kenya Lopez Rabadansenator for BREADdemanded the Supreme Court of Justice of the Nation (SCJN) that asserts the Constitution above any order they may receive from the president Andres Manuel Lopez Obrador (AMLO) in relation to the incorporation of the National Guard to the Secretary of National Defense (Sedena).
During the transmission of contramorning this Monday, August 15, López Rabadán pointed out that the SCJN, as of today, “has a great challenge and that is to decide on the constitutional controversy filed by the presidency of the Chamber of Deputies, regarding the previous decree.”
To understand the senator’s criticism, one must go to the recent context in relation to the methodology in which AMLO is willing to achieve the integration of the GN into Sedena and, at the same time, one must go to 2021, when the president promoted another “I decree” in which megaprojects were promoted as “National security” and, therefore, the information to know your expenses in detail would be under lock and key.
In this regard, the opposition deputies promoted a constitutional controversy before the supreme court; however, this is not resolved. added to this, AMLO He said that, in the event that his National Guard Reform initiative was not approved (like the Electrical Reform), announced that he would promote a decree for reasons of national security so that the GN would be one more appendage of the Sedena.
For what López Rabadán said during the conference that “it is incredible that we do not have an answer, but hopefully and the Court is up to the historical needs and realize the importance of being able to assert their faculties”.
As if the magistrates of the SCJN needed to be repeated, Kenia López insisted that the Court should privilege the Political Constitution of the United Mexican States, “the one they said they were going to obey and they were going to do, that in their actions, every day could be respected”.
“Hopefully, because if the court is subject to the executive power, Mexico will be in serious trouble”
To validate his point of view, he recalled when the members of the court went to the Chamber of Senators and promised to respect the constitution: “they gave their word”. In this sense, he argued that they should not prioritize looking good with AMLO before asserting the Magna Carta.

The senator said that the ministers that make up the SCJN should not prioritize their personal, historical or business relationships with the government before their obligation of constitutional control. “Doing it differently is not only breaking their word, it is breaking what they told different opposition groups.”
It should be remembered that the PAN has criticized both aspects of the current government’s security strategy, since it condemned, from the beginning, López Obrado’s statement in relation to his more humane vision: “hugs, not bullets.” This when referring to the fact that the frontal combat of organized crime must continue, the same one that began Felipe Calderon (BREAD) and continued Enrique Pena Nieto (PRI); and, at the same time, condemns the alleged militarization of Mexico and, therefore, refuses to accept that the GN abandon its civilian command.
